Listing Checker reviews all listings for identified fields that should be checked for accuracy. The Broker, Manager, and Agent are notified by e-mail if there is any discrepancy in the information in the listing when it is compared to public records. The Broker and Agent will be given 48 hours to correct the information or provide some explanation as to the discrepancy. All of this is being done to enhance the integrity of the database. As you know, the database is only as good as the information that we put into it. Failure to respond to notices will result in a fine after the 3rd notice has been sent and the correction not made.

Listing checker currently checks-

  • Status of the Property: (listings will be flagged if they are (1) Pending for more than 120 days or (2) If the active/option status is not updated within 30 days or the RFR is not resolved within 90 days. Sold listings must be reported as sold with selling information including price disclosed. Should a deed record go through the county records and the listing be reported as expired or withdrawn the listing will be researched. If the agent was paid a commission there will be a $5000 fine for the non-disclosure of the sale.
  • Listings Loaded into the Incorrect Map Areas: A map overlay will be used to detect listings that have been entered into an incorrect map area;
  • Remarks Section: Remarks will be checked for words that would be considered a violation by HUD; and/or contain personal promotion. There are no phone numbers, email addresses, or web addresses permitted in public remarks.
  • Land Use: Mobile home listings without real property will be flagged. This is deemed chattel, not real property.
  • Photo: Every listing must have at least 1 photo in the #1 position. In the event of new construction an artists rendering will be acceptable or a map of the parcel. The first email for no photo will be issued 72 hrs. after the list date.

Fines are typically $50, if however, the issue is not resolved or the MLS Committee deems the offense to be a further violation of the Rules and Regulations fines may be increased. Non-Disclosure of sales price will be $5000.

Once these identified fields are in a manageable order, the MLS Committee will add other fields to be checked.

We cannot stress enough the importance of having correct information in the MLS. As you know, MLS information on the internet is in full use and to project a professional image of the REALTOR® and to help limit risk, maintaining the integrity of the database is critical.
